Scope of the service
These draft terms describe use of the smartest.email campaign and audience workspace, including regular email campaigns, subscriber signup forms, sending domain setup, and basic reporting.
Features shown as planned on the pricing page are not available merely because they appear in the product plan. Paid plans are not available yet.
Accounts and team access
You are responsible for accurate account details, for protecting access to your account, and for actions taken by people you authorize to use your organization's workspace. If you act for an organization, you should have authority to do so.
Use the available roles and permissions to limit team access appropriately. Notify the service operator through the support channel provided to your organization if you suspect unauthorized use.
Responsible email sending
You are responsible for your contact lists and for complying with the laws and rules that apply to your messages. This includes obtaining any required permission, providing accurate sender information, and honoring unsubscribes and suppression requests.
Do not use the service for unsolicited bulk email, deception, illegal material, malware, harassment, or content that infringes another person's rights. Do not bypass sending limits, domain checks, or security controls.
Your content and data
You keep your rights to the content and contact data you place in the workspace. You allow smartest.email to store, process, and transmit that material as needed to operate the features you use, including composing, sending, and reporting on campaigns.
You are responsible for the accuracy of your content and for having a lawful basis to provide contact data to the service. The draft privacy page describes current product data handling.
Sending and results
Campaign sending requires a verified sending domain and may be subject to plan limits, permissions, and operational checks. Delivery depends on receiving mail systems and other factors outside the workspace.
Reports record events such as sends, opens, clicks, and unsubscribes. Open and click measurements can be affected by email clients, privacy features, and network behavior, so the figures should be treated as signals rather than a guarantee that a person read a message.
Service availability
The service may change as features are developed and tested. It may be interrupted for maintenance, security work, or fault recovery. No paid service level or dedicated support commitment is currently offered.
Planned tier limits, prices, and advanced feature access are presented for comparison and will need final commercial terms before a paid plan can be purchased.
Security and suspension
Access or sending may be limited or suspended when reasonably needed to investigate abuse, protect users and recipients, meet legal obligations, or preserve the platform's security and reliability.
Account closure and data handling procedures must be finalized before external publication of these terms. This draft should not be treated as a promise of a particular self-service export or deletion workflow.
Changes and legal rights
These are draft terms and have no final effective date. Any final terms should identify the legal service operator, contact details, applicable law, dispute process, and any required limitations or consumer protections before they are published for external use.
Nothing here is intended to remove rights that cannot be waived under applicable law.
